Terms of Service

These Terms of Service (“Terms”) govern your use of the SpaceDSP website, accounts, software, and services (the “Services”), provided by SpaceDSP LLC (“SpaceDSP”, “we”, “us”). By using the Services or purchasing our software, you agree to these Terms. If you don’t agree, please don’t use the Services.

1. Accounts

You sign in using a magic link sent to your email; there are no passwords. You’re responsible for keeping access to your email account secure and for activity under your account. Provide accurate information, and tell us promptly of any unauthorized use.

2. Purchases and payments

Purchases are sold by Lemon Squeezy, our merchant of record. Lemon Squeezy processes your payment, handles applicable taxes (including VAT/sales tax), and issues your receipt; your purchase is also subject to Lemon Squeezy’s terms. Prices are shown at checkout and may change from time to time.

3. Refunds

Refunds are handled by Lemon Squeezy, our merchant of record, in accordance with their refund policy and the refund terms shown at checkout. Consumer-protection laws in your country may give you additional refund or withdrawal rights, which these Terms do not limit.

4. License to the software

Subject to these Terms and your payment, we grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to install and use the SpaceDSP software you purchase on machines you own or control, for your own music production (commercial or non-commercial). You may not:

• redistribute, resell, sublicense, rent, or share the software or your license;
• reverse-engineer, decompile, or circumvent the licensing or security, except where such a restriction is prohibited by applicable law.

Factory presets and content are licensed for use within your own productions, not for redistribution as standalone preset packs. The software is licensed, not sold. If a separate end-user license agreement (EULA) is provided with the installer, that EULA also applies.

5. Your content

You may save and publish presets. You retain ownership of presets you create. By publishing or sharing presets through the Services, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute them as part of the Services. You’re responsible for content you submit (including support messages) and must have the rights to it. We may remove content that violates these Terms or the law.

6. Acceptable use

You agree not to: use the Services unlawfully; infringe others’ rights; attempt to gain unauthorized access to, disrupt, or attack the Services; circumvent licensing or security; or misuse support or other features. We may suspend or terminate access for violations.

7. Intellectual property

The Services, software, website, branding, and content (other than your presets) are owned by SpaceDSP or its licensors and protected by intellectual-property laws. These Terms don’t grant you any rights except the license in Section 4.

8. Disclaimers

The Services and software are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We don’t warrant that the Services will be uninterrupted or error-free. Some jurisdictions don’t allow certain warranty exclusions, so some of the above may not apply to you.

9. Limitation of liability

To the maximum extent permitted by law, SpaceDSP and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue. Our total liability for any claim relating to the Services or software is limited to the amount you paid us for the relevant product in the 12 months before the claim. Some jurisdictions don’t allow these limitations, so they may not fully apply to you, and nothing in these Terms limits liability that cannot be limited by law.

10. Termination

You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Services. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will survive termination.

11. Changes to these Terms

We may update these Terms; we’ll update the “Last updated” date and, for material changes, take additional steps where required. Continued use of the Services after changes means you accept them.

12. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules, and disputes will be handled in the state or federal courts located in Sacramento County, California. If you are a consumer, you may also benefit from the mandatory protections of the country where you live, and nothing here deprives you of those protections.
